ASAM Applauds Revisions to 42 CFR Part 2

 

On July 15, the Partnership to Amend 42 CFR Part 2, of which ASAM is a member, released a statement commending the Substance Abuse and Mental Health Services Administration (SAMHSA) for its adoption of the revised Confidentiality of Substance Use Disorder Patient Records regulation, 42 CFR Part 2.

 

While the revised rule does not alter the basic framework for confidentiality protection of substance use disorder (SUD) patient records created by federally assisted SUD treatment programs, it does make signficant changes to multiple sections of the regulation. These changes were made in conjunction with SAMHSA’s Notice of Proposed Rulemaking in 2019 and are not the result of passage of the CARES Act of 2020. Additional regulatory changes are expected that will implement changes under the CARES Act.
